RESOLUTION
DIRECTING THE APPROPRIATE SENATE COMMITTEE TO INVESTIGATE, IN AID
OF LEGISLATION, THE ALLEGED PROLIFERATION OF "FAKE" PWD
IDENTIFICATION CARDS (PWD-IC) WITH THE END IN VIEW OF ASSESSING
THE IMPLEMENTATION OF REPUBLIC ACT NO. 7277 OR THE MAGNA CARTA
FOR DISABLED PERSONS, AS AMENDED BY REPUBLIC ACT NO. 10754 OR AN
ACT EXPANDING THE BENEFITS AND PRIVILEGES OF PERSONS WITH
DISABILITY AND INSTITUTING SAFEGUARDS WHERE APPROPRIATE

WHEREAS, in 2016, Republic Act No. 7277 or the Magna Carta for Disabled Persons

was amended by Republic Act No. 10754 or An Act Expanding the Benefits and Privileges
3
of Persons with Disability (PWD) to assist PWDs by providing them a 20% discount and
4
value added tax (VAT) exemption on goods and services such as hotels and lodging
5
establishments, restaurants, entertainment centers, drugs and medicines, medical and
6
dental services, air and sea travel, and public transportation;

WHEREAS, according to the 2010 Census of Population and Housing of the
Philippine Statistics Authority (PSA), 1.57% or 1.44 million Filipinos had disabilities;

WHEREAS, a viral photo, showing an entire family with PWD Identification Cards
10
(PWD-IDCs), made rounds on social media on 20 June 2020 which - according to
11
Department of Trade and Industry (DTI) Secretary Ramon Lopez - led to several
12
restaurant owners complaining and reaching out to the department regarding alleged
13
fraudulent uses of PWD-IDCs in their establishments;

WHEREAS, in an article by ANC, restaurant owners shared stories of what they
15
thought were questionable uses of the privileges under R.A. No. 7277 as amended by
