January 2 0 0 7 t o November 20092, t h e Commission observed that
domestic practices o n children's detention continue t o contravene
the C R C , its related instruments, a n d t h e national legislation.
T h e C o m m i s s i o n f o u n d that children w h o h a d been arrested
w e r e n o t i m m e d i a t e l y t u r n e d over t o t h e custody o f t h e social
w o r k e r b u t r e m a i n e d u n d e r police custody beyond t h e required
eight-hour period, w h i c h even lasted f o r several days.
Among
t h e m w e r e c h i l d r e n b e l o w t h e age o f c r i m i n a l responsibility.
T h e C o m m i s s i o n also f o u n d children i n jails a n d t h e n a t i o n a l
p e n i t e n t i a r y p e n d i n g t h e t r i a l o f t h e i r cases d u r i n g visits conducte

J a n u a r y 2 0 0 8 t o M a r c h 2009.4 S o m e courts a r e still
exhibiting reluctance
