DECISION PUNO, J.: Before us is an appeal from the decision of the Regional Trial Court in Criminal Case No. 93871 convicting accused-appellant Patricio Botero of illegal recruitment in large scale and sentencing him to suffer the penalty of life imprisonment.[1] In an Information dated July 21, 1992, accused-appellant Patricio Botero together with Carlos P. Garcia and Luisa Miraples were charged with the crime of illegal recruitment in large scale defined by Article 38 (b) and penalized under Article 39 (a) of the Labor Code, as amended by Presidential Decree Nos. 1920 and 2018, committed as follows: "That on or before March 2, 1992, and subsequently thereafter, in the Municipality of Mandaluyong, Metro Manila, Philippines, a place within the jurisdiction of this Honorable Court, the above-named accused, conspiring and confederating together and mutually helping and aiding each other, representing themselves to have authority, license and/or permit to contract, enlist and recruit workers for overseas employment, did then and there willfully, unlawfully and feloniously for a fee, recruit and promise job placement/employment abroad to the following individuals, to wit: 1. 2. 3. 4. 5. 6. 7. 8. 9. 10. 11. 12. 13. 14. 15.
