“Here in Zambo, we have only one family court hence the court docket for
RA 9262 violation is full” (Judge-Respondent 5, Personal Communication,
October 27, 2020).
From these responses the following are drawn as factors for the delay in
legal cases:
1.
2.
3.
4.
5.
possibility of plea bargaining
undecisiveness of complainant
Absence of respondent
postponement of lawyers
legal process from arraignment/preliminary conference, then
pretrial, mediation to preserve family solidarity for possible
settlement. Timetable is usually extended
6. If no settlement of reconciliation the possible separation of property
and amount of support
7. Clogged court dockets due to first in first out policy of courts
8. earnest efforts taken by the court to settle the differences among
the members of the family
9. ethnic/religious beliefs of the litigants which allow the entry for
compromises and settlement especially if the elders intervene
10. police officers in the VAWC desk take time to make their reports
11. prosecutors also fail to file the case in court the soonest
12. only one family court in Zamboanga City hence the court docket for
RA 9262 violation is full.
On Locale, as to what places where these VAW incidents have been
reported from, per their respective records, the respondent state actor
representatives generally said the violence occurs at the victims’
respective residences, with qualifications, or further elaboration:
For the ZCPO, at their barangays and district stations, where the reporting
is done, six of which are nearest to the commercial area (pueblo) in
Zamboanga City:
Ayala, Tetuan,
Sta. Maria, Calarian, Divisoria,
Pasonanca.
For the CSWDO, the violence (particularly verbal and psychological)
transpires at the residences, but may be continued at the BLGU-VAW
corners.
For the CHR, the violence transpires at the residences, and during
investigation, could accelerate even before CHR investigators.
