▪ ▪ ▪ ▪ DENR issuing sand and gravel permits without endorsing applications to NCIP for the FPIC requirement (e.g. Itogon and Along Bued River, Tuba); State denial and non-recognition of IP collective rights of ownership, priority use and management over ancestral lands and resources; Executive Order 30 Series of 2018 entitled “Creating the Energy Investment Coordinating Council in Order to Streamline the Regulatory Procedures Affecting Energy Projects” or EICC Republic Act No. 11234 otherwise known as “An Act Establishing the Energy Virtual One-Stop Shop for the Purpose of Streamlining the Permitting Process of Power Generation, Transmission and Distribution Projects” or EVOSS; and Republic Act No. 11032 or the Ease of Doing Business law or EODB Government development and socio-economic projects in the name of “national development” or “national interest” such as megadams, large-scale mines, megatourism, NIPAS, etc) causing damage to the ADs of IPs/ICCs (e.g. Nagan-Maton, Apayao Critical Habitat); Military reservations inside ADs. While all ADs are presumed to be ‘peace zones’ – free from the conflict being waged between the AFP and rebel groups, there are scattered military detachments situated within the ADs. These detachments were erected without undergoing FPIC; and Political misrepresentation. Mainstream political structures decide for the ADs undermining the existing collective indigenous political structures. Most of the time, this is being done on development projects. ➢ Indigenous Peoples Education program: ▪ Inadequate educational assistance slots for needy IP youths. The slot is limited to 885 for the whole region which is too little to accommodate the greater number (almost 2,000 applicants) of poor but deserving students; and ▪ Inability to access the right to education during the COVID-19 community quarantine. IP students were unable to keep up with the online/distance classes adopted by DepEd as some cannot afford an android phone let alone the cost of data load. And if they can, they have no internet access due to poor signal. 31 P a g e CHR CAR REGIONAL HR SITUATION REPORT – JANUARY to JUNE 2020
