T h e Local Councils for the Protection o f Children (LCPC) are
vital i n the prevention o f juvenile delinquency.
They have the
p r i m a r y role i n coordinating a n d assisting L G U s t o adopt "a
comprehensive p l a n o n delinquency prevention, a n d t o oversee its
p r o p e r i m p l e m e n t a t i o n " ( S e c t i o n 15). H o w e v e r , L C P C s h a v e y e t t o
be established and/or strengthened i n m a n y local government
units.
T h e use o f diversion processes a t t h e barangay a n d police
levels n e e d t o b e m a i n s t r e a m e d , as w e l l . T h e d i v e r s i o n p r o c e s s a s
a n alternative t o court procedures w o u l d likely lessen t h e
unnecessary d e t e n t i o n o f children n o t o n l y i n jails b u t also i
detention centers.
Detention o f children i n jails contravenes t h e declared
policies o f t h e State, as articulated i n the J J W Act o f 2 0 0 6 ,
p r o m o t e a n d protect the physical, m o r a l , spiritual, intellectual a n
social well-being o f children; a n d t o apply t h e principles o
restorative justice i n all its laws, policies a n d p r o g r a m s applicab
to children i n conflict w i t h the l a w (Section 2).
RECOMMENDATIONS:

following recommendations:
