In light of the foregoing conclusion, there is no necessity of discussing the other presented issues.             WHEREFORE, premises considered, the instant Petition is DENIED for lack of merit and the decision of the Court of Appeals dated 17 June 2008 and the resolution of the same court dated 25 September 2008 in CA G.R.
