SEC. 19. Record of Transaction, The Commission shall keep proper accounts and
records of all its transactions and affairs, and shall exert all efforts to ensure that all
payments made out of its moneys are correctly made and properly authorized, and that
adequate control is maintained over the assets of, or in the custody of, the Commission
and the expenditures it may incur. The Commission shall be subject to audit by COA.
SEC. 20. Civil Service law Coverage for Employees. The hiring, appointment,
employment, promotion, disciplinary control, separation, and other terms and
conditions of the service of all employees of the Commission and such other matter
affecting its employees shall be consistent with the provisions of the Civil Service Law,
rules and regulations.
SEC. 21. GSIS Coverage for Emp/oyees. All employees of the Commission shall
be deemed members of the Government Service Insurance System and shall enjoy all
the benefits of said System.
SEC. 22. Transitoory ProvMons, Upon the creation of the Commission, the OMA
shall cease to operate. All the powers, functions, assets, liabilities, capital, accounts,
contracts, equipment, and facilities of the OMA which are owned by the government,
shall be transferred to the Commission.
During the transition period which begins upon approval of this Act, the
President may appoint the incumbent Executive Director of the OMA as Acting Chairman
of the Commission until the Chairman of the Commission shall have been appointed.
All regular or permanent employees may be absorbed or transferred to the
Commission, provided they possess the necessary qualifications, and shall not suffer
any loss of seniority or rank or decrease in emoluments.
Employees separated and/or phased-out from the service as a result of the
abolition of the OMA under the provision of this Act, shall within three (3) months from
their separation and/or phase-out from the service, receive a separation pay in
accordance with existing laws, rules and regulations.
I n addition, those who are
qualified to retire shall be allowed to retire and be entitled to all benefits provided under
any of the existing retirement laws. The fund of the Commission maybe used to fund
this purpose.
The Chairman shall recommend to the Commission a work program that shall
include the organizational plan and structure, staffing pattern and compensation plan,
budget, programs, projects, activities of the Commission within ninety (90) days from
