WHEREFORE, all the foregoing considered, the petition is GRANTED. The Decision
dated May 27, 2011 of the Court of Appeals in CA-G.R. SP No. 108142 is REVERSED
and SET ASIDE. Accordingly, the respondents’ complaint docketed as NLRC NCR OFW
Case No. (M) 06-12-03874-00 before the Labor Arbiter is DISMISSED.
