Nature of the case: The accused, the common-law spouse of the victim’s mother had sexual intercourse with the said victim, who was then thirteen (13) years old at the time of the commission of the offense, against her will and consent. The accused denied having sexual intercourse with the victim against her will and raised the sweet heart defense but was rejected by the Court. Thus, the accused was convicted for the crime of qualified rape and sentencing him to suffer the penalty of reclusion perpetua without eligibility for parole. The accused was further ordered to support the offspring born as a consequence of the rape.

Summary of outcome: The offender is sentenced to suffer reclusion perpetua without eligibility for parole and is ordered to pay the victim P100,000.00 as civil indemnity, P100,000.00 as moral damages, and P100,000.00 as exemplary damages, all damages awarded shall earn interest at the rate of 6% per annum from the date of finality of the decision until fully paid.

He is further ordered to support the offspring born as a consequence of the rape. The amount of support shall be determined by the trial court after due notice and hearing, with support in arrears to be reckoned from the date the appealed decision was promulgated by the trial court.
