Anti-Violence Against Women and their Children Act of 2004 (VAWC)

Nature of the case: The accused who is the ex-boyfriend of the victim sent the said victim by cellphone message the picture with her face pasted on the body of a nude woman, inflicting anguish, psychological distress, and humiliation on her. The accused argued that the act of sending an offensive picture should not be considered a form of harassment. He claims that such would unduly ruin him personally and set a very dangerous precedent. His wife also testified that it was the victim who sent the obscene pictures of herself of which the Court was not impressed. In fine, the Court finds that the prosecution has proved each and every element of the crime charged beyond reasonable doubt and the accused is therefore convicted for the crime violating Section 5 (h) of RA 9262.

Summary of outcome: The accused was found guilty of violating Section 5(h) of R.A. 9262.
