DECISION
PEREZ, J.:
This is a Petition for Review on Certiorari under Rule 45 of the 1997 Rules
of Civil Procedure filed by petitioner Alex C.Cootauco (petitioner) assailing the:
(1) Decision of the Court of Appeals dated 17 June 2008 in CA G.R. SP No.
101324,[1] which affirmed the Resolutions dated 31 May 2007[2] and 31 August
2007,[3] issued by the National Labor Relations Commission (NLRC) in NLRC CA
No. 050470–06 reversing the decision of the Labor Arbiter, granting the
petitioner’s claim for disability benefits. The NLRC, as a result, disallowed
petitioner’s claim for said benefits. Likewise assailed is the resolution of the Court
